Hello Winston! I read that you were in court yesterday in Cranbrook. Our local newspaper reported that you had applied for government funding for your defense. Would you mind explaining why you think that our taxpayer dollars should help you in your defense?

Yes, I was in court on April 22.  No, I don’t mind explaining why I think that I should be given funding in my defense.  In the first place, Mr. Arvay explained in court that the decision of a Special Prosecutor was final under the The Crown Counsel Act.  I know that the existing AG always puts a little disclaimer of his own when he talks about the Special Prosecutor, but it seems to be missing in the Act.

Back on February 3, 1992 a Special Prosecutor named Richard P. Anderson Q.C. delivered a decision upon polygamy which I quote from; “Section 293 is in direct conflict with Section 2(a) of the Charter and cannot be saved under Section 1 of the Charter”. He provided several pages of judicial reasoning which gave our religion and people consideral comfort that we were protected with all Canadians by the Charter, which was only ten years old at the time, but definitely scripted to protect all of the cultural diverse communities that make up our beautiful Canada. From the hippies with their free love to the polygamist Muslim and Sikh communities, and yes the Fundamentalist Mormons, we are all proudly Canadians. Our Charter has become what Canada is. Special Prosecutor Mr. Peck delivered the same opinion and it should have been final.  Mr. Doust did the same thing and it should have been final.

Just suppose that some foreign force attacked our Canada and sent in their army to destroy it, would you think it prudent, wise or fair, for the Government of Canada to call on one farmer from out west to defend the nation with proceeds from his grain crop, and with his gopher rifle and own ammunition be called upon to defend the freedoms of us all while the rest of Canada sat by and watched the show? This is not just about our faith.  It is about all Canadians and their rights to be who they are and live their religion. This is an attack on the basic freedoms that we should all enjoy and every Canadian should defend it.

The constitutional challenge of polygamy

Monday, April 13th, 2009

Why were no women charged? Did Oppal not relish the optics of responding to a woman’s constitutional challenge by claiming that her protection justifies the prohibition?
